Terms and Conditions

Zurfex may allow users to request, provide, book, manage, track, or pay for services through the platform.

Unless expressly stated otherwise, Zurfex acts as a technology platform and may not directly provide the underlying third-party services listed, requested, scheduled, or completed through the platform.

Zurfex does not guarantee the availability, timing, quality, safety, legality, pricing, suitability, completion, or outcome of any service, listing, request, provider, vendor, driver, user, or third-party transaction.

Users and service providers are responsible for fulfilling their own commitments, complying with applicable laws, and maintaining any required licenses, permits, insurance, registrations, approvals, background checks, or professional qualifications.

Any agreement, transaction, service arrangement, or dispute between users and third parties is primarily between those parties, unless Zurfex Inc expressly agrees otherwise in writing.

Zurfex may charge fees for access, subscriptions, bookings, services, transactions, commissions, or other platform features.

By using paid features, you agree to pay all applicable fees, taxes, and charges. Payment terms may be shown at checkout, in your account, or in a separate agreement.

Payments may be processed by third-party payment processors. By making or receiving payments through Zurfex, you may also be subject to the terms, conditions, and privacy policies of those payment processors.

Zurfex Inc is not responsible for delays, errors, declined payments, chargebacks, payment processor outages, bank fees, card issuer actions, or third-party payment processing failures, except where required by law.

Zurfex may change pricing or fees at any time, subject to applicable law and any existing written agreement.

Failure to pay required amounts may result in suspension, restriction, or termination of access.

Cancellation and refund rules may depend on the service, provider, booking type, subscription, or transaction.

Unless otherwise stated, all fees are non-refundable once a service has been confirmed, started, completed, or made available.

Zurfex may issue refunds or credits at its discretion or as required by law.

Users, providers, vendors, drivers, businesses, and other platform participants are responsible for determining, collecting, reporting, and paying any taxes, duties, assessments, or government charges related to their activities, income, sales, purchases, services, or transactions through Zurfex, except where Zurfex Inc is legally required to collect or remit taxes.

You may be able to submit content, including profile details, business information, reviews, messages, photos, documents, service information, or other materials.

You retain ownership of your content, but you grant Zurfex a worldwide, non-exclusive, royalty-free license to use, host, store, display, reproduce, modify, and distribute your content as needed to operate, improve, market, and protect the platform.

You are responsible for ensuring that your content is accurate, lawful, and does not violate the rights of others.

Zurfex may remove or restrict content that violates these Terms or applicable law.

By creating an account or using Zurfex, you agree that Zurfex may contact you by email, SMS, phone, push notification, or in-app message regarding your account, transactions, security, updates, promotions, and service-related communications.

You may opt out of promotional messages where required by law, but you may still receive important account or service communications.

Your use of Zurfex is also governed by our Privacy Policy, which explains how Zurfex Inc collects, uses, stores, shares, sells, and protects personal information.

Zurfex, including its name, logo, design, software, features, text, graphics, branding, and platform content, is owned by Zurfex or its licensors and is protected by intellectual property laws.

You may not copy, modify, distribute, sell, lease, reverse engineer, or create derivative works from Zurfex’s platform or intellectual property without written permission.

You may not use the Zurfex name, Zurfex Inc name, logos, branding, domain names, screenshots, trade dress, slogans, or confusingly similar marks without prior written permission from Zurfex Inc.

Zurfex may contain links, integrations, payment processors, maps, communication tools, analytics tools, or services provided by third parties.

Zurfex is not responsible for third-party websites, services, terms, policies, actions, errors, or content.

Your use of third-party services may be subject to separate terms and privacy policies.

Zurfex aims to provide reliable access but does not guarantee that the platform will always be available, uninterrupted, secure, accurate, complete, or error-free.

We may suspend, limit, or update the platform for maintenance, security, legal, business, technical, or operational reasons.

Zurfex Inc will not be liable for delays, failures, interruptions, data loss, service unavailability, or performance issues caused by events beyond our reasonable control, including natural disasters, extreme weather, fires, floods, earthquakes, pandemics, labor disputes, power failures, internet outages, cyberattacks, government actions, war, terrorism, civil unrest, third-party service failures, payment processor failures, cloud hosting failures, or other force majeure events.

To the maximum extent permitted by law, Zurfex and its owners, officers, employees, contractors, affiliates, partners, and licensors will not be liable for indirect, incidental, special, consequential, punitive, or exemplary damages, including loss of profits, revenue, data, goodwill, business opportunity, or service interruption.

Zurfex’s total liability for any claim related to the platform will not exceed the amount you paid to Zurfex in the three months before the claim arose, or $100, whichever is greater, unless applicable law requires otherwise.

You agree to defend, indemnify, and hold harmless Zurfex and its owners, officers, employees, contractors, affiliates, partners, and licensors from any claims, damages, losses, liabilities, costs, and expenses, including reasonable legal fees, arising from:

• Your use or misuse of Zurfex;
• Your violation of these Terms;
• Your violation of any law or regulation;
• Your content or information submitted to Zurfex;
• Your interaction, transaction, or dispute with another user or third party.

Zurfex may suspend, restrict, or terminate your account or access at any time, with or without notice, at our sole discretion, including if:

• You violate these Terms;
• Your account creates security, legal, financial, reputational, or operational risk;
• Required information is inaccurate, incomplete, misleading, or outdated;
• Payment is overdue, disputed, reversed, or declined;
• You misuse the platform, other users, or third-party services;
• Zurfex decides to discontinue, modify, limit, or restructure the platform.

Zurfex Inc is not liable for any loss of access, loss of data, lost opportunities, lost revenue, or other consequences resulting from a lawful suspension, restriction, or termination.

You may stop using Zurfex at any time. Certain obligations, including payment obligations, intellectual property rights, disclaimers, limitations of liability, dispute resolution terms, and indemnification, will survive termination.

You are solely responsible for your interactions, communications, transactions, agreements, and conduct with other users, testers, service providers, vendors, drivers, businesses, owners, or third parties on or through Zurfex.

Zurfex Inc and Zurfex are not responsible or liable for any criminal, civil, contractual, personal, financial, or legal issues, disputes, claims, damages, injuries, losses, or incidents that arise between users, testers, owners, or any third parties, whether occurring online or offline.

This includes, but is not limited to: disputes between testers and owners; service-related disagreements or failures; misconduct, negligence, or illegal acts by any user or third party; personal injury, property damage, or financial loss; fraud, misrepresentation, or breach of agreement between parties.

Zurfex may, at its sole discretion, attempt to facilitate dispute resolution, but is under no obligation to do so and does not act as a mediator, arbitrator, insurer, or enforcement authority.

By using Zurfex, you agree to release Zurfex Inc from any and all claims, demands, and damages arising out of or in any way connected with disputes between you and other users or third parties, except where such limitation is prohibited by applicable law.

To the maximum extent permitted by law, you and Zurfex Inc agree to resolve disputes through final and binding individual arbitration, rather than in court, except for claims that may legally be brought in small claims court or claims related to intellectual property misuse, unauthorized access, or injunctive relief.

You and Zurfex Inc agree that any dispute will be brought only on an individual basis and not as a plaintiff, class member, or representative in any class action, collective action, consolidated action, private attorney general action, or representative proceeding.

The arbitrator may award relief only to the individual party seeking relief and only to the extent necessary to resolve that individual claim.

Nothing in this section prevents either party from seeking emergency injunctive relief in court where necessary to protect intellectual property, confidential information, platform security, user safety, or unauthorized use of the platform.

If any part of this arbitration or class action waiver section is found unenforceable, the remaining parts will remain in effect to the fullest extent permitted by law.
